1. Overview
We respond to properly formatted DMCA takedown notices. Submitting a false or misleading DMCA notice may expose the complainant to legal liability. We take intellectual property rights seriously and will act promptly on valid notices.
2. Notice Requirements
A valid DMCA takedown notice must include:
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and information reasonably sufficient to locate it (URL or service identifier)
- Your contact information (name, address, phone number, email address)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
- A physical or electronic signature
3. How We Respond
Upon receiving a valid DMCA notice, Spiral Technologies may remove or disable access to the allegedly infringing material, suspend or terminate the associated services, notify the customer, preserve records for potential legal proceedings, and forward the complaint to the customer or upstream providers.
Repeated infringement may result in account termination without refund.
4. Counter-Notice
If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or New York if outside the US), and that you will accept service of process from the complainant
Spiral Technologies may restore material if permitted by law and not otherwise prohibited by policy or upstream provider requirements.
5. No Refunds for DMCA Terminations
Services terminated or suspended due to DMCA violations or repeated copyright infringement are not eligible for refunds, SLA credits, or data recovery guarantees.
